01 Acceptance of Terms

By accessing or using the website at prohomeremodels.com (the "Site"), requesting a quote, or entering into any service agreement with ProHome Remodels, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site or engage our services.

These Terms apply to all visitors, clients, leads, and others who access or use the Site or any service offered by ProHome Remodels. We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

02 Services & Scope of Work

ProHome Remodels provides residential and commercial construction, remodeling, and renovation services throughout Orange County, California. Services include but are not limited to:

All services are subject to a written contract between ProHome Remodels and the client. The scope, timeline, and pricing of any project are governed by the applicable written agreement, not these Terms alone. Nothing on this Site constitutes a binding offer or contract for services.

03 Licensing & Compliance

ProHome Remodels operates under California Contractors State License Board (CSLB) license #1140564. All work is performed in compliance with applicable California building codes, local municipal regulations, and permit requirements.

Clients are responsible for providing accurate information about their property, including any HOA restrictions, easements, or deed restrictions that may affect the scope of work. ProHome Remodels is not liable for project delays or additional costs arising from undisclosed property conditions.

04 Estimates, Quotes & Pricing

All estimates and quotes provided — whether verbally, via the Site, by email, or by phone — are preliminary and non-binding until formalized in a signed written contract. Estimates are based on information available at the time of assessment and are subject to change based on actual site conditions, material costs, and project scope.

ProHome Remodels reserves the right to adjust pricing prior to contract execution. We are not responsible for typographical errors or pricing discrepancies displayed on the Site or in any marketing materials.

05 Payment Terms

Payment schedules, deposit requirements, and final payment terms are specified in each individual written contract in compliance with California Business and Professions Code §7159. Under California law:

Late payments may be subject to interest charges as specified in the applicable written contract. ProHome Remodels reserves the right to suspend work on any project where payment obligations are not met.

06 Changes & Change Orders

Any changes to the agreed scope of work must be documented in a written change order signed by both parties before work proceeds. Verbal agreements to change or expand scope are not binding on ProHome Remodels.

Change orders may affect project cost, timeline, and warranty coverage. ProHome Remodels will provide a written cost and timeline impact for all requested changes before work begins.

07 Project Timeline & Delays

Project timelines are estimates provided in good faith. ProHome Remodels is not liable for delays caused by circumstances beyond our control, including but not limited to:

We will communicate any anticipated delays promptly and work to minimize their impact on your project.

08 Warranty

ProHome Remodels warrants all labor and workmanship against defects for a period of one (1) year from the date of substantial project completion, unless a longer period is specified in the written contract.

Material warranties are provided by the respective manufacturers and are passed through to the client to the extent permitted. ProHome Remodels does not extend or modify manufacturer warranties.

Warranty coverage is void if:

09 Limitation of Liability

To the fullest extent permitted by California law, ProHome Remodels' total liability for any claim arising out of or related to our services shall not exceed the total amount paid by the client under the applicable contract.

ProHome Remodels shall not be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, lost profits, or loss of property value, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or as otherwise prohibited by applicable California law.

10 Intellectual Property

All content on this Site — including text, photographs, graphics, videos, logos, and design elements — is owned by or licensed to ProHome Remodels and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Site content without our prior written consent. Requests for media use may be directed to us at the contact information below.

11 Website Use

You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others. You may not:

12 Dispute Resolution

In the event of a dispute arising from or related to these Terms or any service provided by ProHome Remodels, the parties agree to first attempt resolution through good-faith negotiation.

If negotiation fails, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Construction Industry Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

Clients may also have the right to file a complaint with the California Contractors State License Board (CSLB) at cslb.ca.gov.

13 SMS/Text Messaging Terms of Service

ProHome Remodels SMS Program

By opting in to the ProHome Remodels SMS program, you consent to receive text messages related to your remodeling inquiry, project updates, appointment reminders, promotional offers, and other communications from ProHome Remodels. Message frequency varies based on your interactions with us.

Opt-Out Instructions

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode or number from which you received messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

14 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Orange County, California.
